Article 9(2) of Regulation (EU) 2018/1139 sets out the essential requirements for environmental protection referring to:
- the environmental protection requirements (EPRs) contained in Volumes I, II, and III of ICAO Annex 16 (first subparagraph), and
- the essential requirements for environmental compatibility set out in Annex III of Regulation (EU) 2018/1139 (second subparagraph).
The purpose of this rulemaking task (RMT) is to:
- develop detailed EPRs for products for which Volumes I, II and III of ICAO Annex 16 do not contain applicable Standards and Recommended Practices (SARPs). These detailed EPRs should be adopted in a Commission Delegated Regulation in accordance with Article 19(1)(a) of Regulation (EU) 2018/1139.
- develop the related acceptable means of compliance (AMC) and guidance material (GM).
- update Regulation (EU) No 748/2012 and the related AMC and GM to ensure the consistent implementation of the developed detailed EPRs for the product certification or declaration of compliance.
- update other Regulations to ensure consistency within the overall EU regulatory framework.
The objective is to maintain a high uniform level of environmental protection and to contribute to European policies on climate change, air quality and noise reduction.
This RMT is a permanent vehicle to address the development of new detailed EPRs. The Subtasks are specified in Volume II of the latest EPAS.
