About the EASA Board of Appeal
The EASA Board of Appeal (BoA) is part of the administrative structure of the European Union Aviation Safety Agency (EASA), however, it issues its findings independently. The EASA BoA is responsible for deciding on appeals against certain decisions of the Agency. Pursuant to Article 108 of Regulation (EU) 2018/1139, an appeal may be brought against decisions of the Agency which have been taken in the following fields:
- investigation of undertakings;
- airworthiness and environmental certification; and
- Regulation (EU) 2019/2153 (the ‘Fees & Charges Regulation’).
Certain decisions of the Agency concerning labels for flights are subject to appeal before the EASA BoA according to the ‘ReFuelEU Aviation Regulation’ (Regulation (EU) 2023/2405 of 18 October 2023).
Important information
Any appeal should be submitted directly to the Registrar of the Board of Appeal. To facilitate the lodging of appeals, the Agency provides an Appeal Form.
Appellants are also invited to read carefully the EASA BoA Rules of Procedure and Practice Directions to Parties to Appeal Proceedings, designed to assist parties in their appeal proceedings.
Appeal charges shall be paid to the Agency for processing an appeal lodged pursuant to Article 108(1) of Regulation (EU) 2018/1139. The amounts of the fees are regulated by Implementing Regulation 2019/2153 of 16 December 2019 on the fees and charges levied by the European Union Aviation Safety Agency.
The Members of the EASA Board of Appeal
The members and their alternates are appointed by the EASA Management Board from a list of qualified candidates established by the European Commission. The term of office of the members of the EASA Board of Appeal (BoA), including the Chairperson and any alternates, shall be five years and shall be extendable for a further five years. The members of the BoA shall be independent. In making their decisions, they shall neither seek nor take instructions from any government or other body.
Regulation (EC) No 104/2004 of 22 January 2004 lays down the rules for the organisation and composition of the EASA BoA. There is only one established Board that consists of two technically qualified members and one legally qualified member who also serves as the Chairperson. This composition is mirrored in the alternate members.

Registrar of the EASA Board of Appeal
The EASA Board of Appeal (BoA) is assisted by a Registrar, who is appointed by the EASA Executive Director. Personnel in charge of the registry shall not participate in any Agency proceedings relating to decisions that can be brought under appeal. In the exercise of these duties, the Registrar is subject only to the authority of the BoA.

Inter-Agency Appeal Proceedings Network
The EASA Board of Appeal is member of the Inter-Agency Appeal Proceedings Network (IAAPN), established in 2018. The IAAPN's is a subnetwork of the broader EU Agencies Network and its aim is to promote cooperation, coordination, as well as sharing of knowledge and best practice on common appeal proceedings’ issues.
