1178/2011 Part-MED, application of ARA.MED.330 "special medical circumstances"

Under rule ARA.MED.330 Special medical circumstances ...
... new medical technology may, after evaluation, be put into force and is considered applicable in cases where under Part-MED a candidate would be considered "unfit", to consider him "fit".

It is said, that at least Austria has applied ARA.MED.330 against MED.B.025 b) (diabetes mellitus).

The question is:
"If one member state has successfully applied ARA.MED.330, may that result be available in all member states???" ... I wonder if somebody knows.

Dear Jürgen,
Sorry for the long time taken to answer your question but we had to discuss internally... Unfortunately no, since point ARA.MED.330(f) says that holders of such special medical certificate shall be restricted to exercise their privileges only within those Member States which are involved in the relevant research protocol.
