FCL Organisations Approvals

In accordance with Articles 7 and 21 of the new Basic Regulation, Regulation (EC) No 216/2008 of the European Parliament and of the Council of 20 February 2008, which entered into force on 8 April 2008, the Agency has been given a number of new tasks with regard to Pilot Training Organisations (PTOs) (known as TRTOs: Type Rating Training Organisations, FTOs: Flight Training Organisations and R/F: Registered Facilities under JAR FCL) and Aero-Medical Centres (AeMCs) located outside the territory of the Member States.

In particular the Agency shall:

  • Conduct, itself or through National Aviation Authorities or Qualified Entities, investigations and audits of the organisations it certifies;
  • Issue and renew the certificates of Pilot Training Organisations and Aero-Medical Centres located outside the territory of the Member States and, where relevant, their personnel;
  • Amend, limit, suspend or revoke the relevant certificate when the conditions according to which it was issued by it are no longer fulfilled, or if the legal or natural person holding the certificate fails to fulfil the obligations imposed on it by this Regulation or its implementing rules.

The EASA Flight Crew Licencing Organisation Approval (FCLOA) Section is responsible for:

  1. The management of all applications for approval of Pilot Training Organisations and Aero-Medical Centres for which the Agency is the competent authority in accordance with Article 21(1)(b) of Regulation (EC) No 216/2008.
  2. The tasks related to their certification and continued surveillance.

Additional information about the regulation

JAR-compliant organisations

Pursuant to Article 10a paragraph 2 and Article 10c paragraph 2 of Amended Aircrew Regulation, Pilot Training Organisations and Aero-Medical Centres holding JAR-compliant certificates (see definition (13) of Article 2 of Amended Aircrew Regulation) are deemed to hold a certificate issued in accordance with Part ORA of Amended Aircrew Regulation.

In such case the privileges the Pilot Training Organisations are limited to the privileges included in the approval issued by the Member State (Article 10a paragraph 2 of Amended Aircrew Regulation)

Transfer of authority

Organisations located outside the territory of the Member States holding a valid JAR-compliant certificate issued before April 8th 2012 are no longer under the Member States authority exercising oversight over Pilot Training Organisations and Aero-Medical Centres (Article 21 paragraph (b) of basic regulation and ORA.GEN.105 (a)(1)(ii) in Section 1 of Annex VII of Amended Aircrew Regulation).

These organisations shall contact the Agency (by using the application form as indicated below) to:

  • Provide the information needed to update and validate the List of EASA approved organisations
  • Initiate the oversight planning cycle related to the approval continuation

Timescale

Organisations located outside the territory of the Member States holding a valid JAR-compliant certificate issued before April 8th 2012 and expiring:

before July 2012

shall contact the Agency as indicated above as soon as possible

after June 2012

shall contact the Agency at least 3 months before the certificate expiry date
or
apply for a change if the scope or the terms of approval need to be changed

Organisations under on-going approval processes

Organisations located outside the territory of the Member States undergoing an approval process:

  • initiated before 08 April 2012 for the issuance of:
    • an initial JAR FCL approval, or
    • a change of a JAR FCL approval issued before 08 April 2012
  • by a Member State having implemented JAR FCL and having been recommended for mutual recognition

are advised that the current approval process will be finalised by that Member State. The Agency becomes the Competent Authority at the end of the approval process after the issuance of the certificate by the Member State.

In this case the JAR FCL approved organisations are expected to contact the Agency as indicated above.

Initial approval

Pilot Training Organisations and Aero-Medical Centres located outside the territory of the Member States seeking an approval under Part ORA of Aircrew Regulation shall apply using the Application Form as indicated below
